Aloy Ejimakor, lead counsel for Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), has appealed to President Bola Ahmed Tinubu to take decisive action in resolving Kanu’ s case, a matter that has attracted international attention and criticism. Ejimakor’ s statement emphasizes the urgency of adhering to a directive from the United Nations (UN) that called for Kanu’ s release and compensation, issued during the administration of former President Muhammadu Buhari. In July 2022, the UN Human Rights Council’ s Working Group on Arbitrary Detention delivered a landmark opinion regarding Kanu’ s case. The group found Kanu’ s detention and extraordinary rendition from Kenya to Nigeria in June 2021 to be in violation of international laws. They recommended his immediate release and compensation. Ejimakor highlighted that this 17- page opinion is legally binding, as Nigeria is a member of the United Nations and a signatory to key international treaties, including the International Covenant on Civil and Political Rights and the Universal Declaration of Human Rights.
The UN directive stated unequivocally: ” The Working Group considers that, taking into account all the circumstances of the case, the appropriate remedy would be for the Government of Nigeria to release Mr. Kanu immediately and accord him an enforceable right to compensation and other reparations, in accordance with international law. ” Despite the gravity of this decision, Ejimakor lamented that the Buhari administration ignored the UN’ s recommendation throughout its tenure.
Now, Ejimakor argues, the responsibility lies squarely with Tinubu to correct this failure. ” Unlike a misguided Buhari, a wiser President Tinubu can do the right thing by freeing Mazi Nnamdi Kanu without further ado, ” Ejimakor stated. He further emphasized that the issue has shifted from a purely legal matter to a political one, and Tinubu, as the nation’ s leader, has the authority to act decisively.
Ejimakor also underscored the prolonged suffering Kanu has endured, having been detained for over three years without legal justification. He urged Tinubu to prioritize justice and demonstrate Nigeria’ s commitment to upholding international law by promptly implementing the UN directive. According to Ejimakor, this action would not only restore Kanu’ s rights but also reinforce Nigeria’ s standing as a responsible member of the international community.
