The Independent National Electoral Commission (INEC) has clarified the rationale behind declaring Bola Ahmed Tinubu the winner of the 2023 presidential election at 2 a. m.
INEC announced Tinubu’ s victory on March 1, representing the All Progressives Congress (APC) with a total of 8, 794, 726 votes. This count placed him ahead of his main competitors, Atiku Abubakar of the Peoples Democratic Party (PDP) and Peter Obi of the Labour Party (LP).
The timing of this announcement has raised questions and concerns among some Nigerians. In response, INEC Chief Press Secretary Rotimi Oyekanmi has explained that there is no legally mandated time for the declaration of election results stipulated in the constitution or the Electoral Act.
Oyekanmi elaborated that, in a presidential election, the entire country functions as a single constituency. Votes are first counted at polling units, then aggregated at the ward, local government, and state levels before the final results are presented to the Chief Electoral Commissioner in Abuja.
He noted that the timing of the announcement was influenced by the need to wait for all 36 returning officers, including those from remote locations, to submit their results. According to the Electoral Act, these results must be brought in and the returning officers interviewed.
The chairman must question these officers and review all submitted figures before results can be finalized and declared. This process contributed to the late- hour announcement, which some critics have cited as being done in the middle of the night.
” However, Prof. Attahiru Jega declared the 2015 results around 4 am. The constitution does not prescribe a specific time for declaring election results, ” he added.
