Several retired judges and Senior Advocates of Nigeria (SANs) have expressed their belief that the Nigerian Police Force should be in charge of investigating the recent tragic killings of 17 soldiers and an unconfirmed number of villagers in Okuama, Delta State.
They criticized the decision to hand over the traditional ruler of Ewu Kingdom, HRM Clement Ikolo, who was declared wanted by the Defence Headquarters, to the Army, emphasizing that it is not within the Army’ s constitutional duty to conduct such investigations.
According to legal experts such as Okoi Obono Obla, Cosmos Enwelizor, Chief Magistrate E. O. Eferakoro, Uwemedimo Nwoko, Miakpor Emiaso, and Hon. Justice Jonathan. E. Shakarho, the Army should refrain from getting involved in investigations and allow the Police to handle the matter.
They emphasized that the constitution does not grant the Army the authority to declare individuals wanted, arrest, or prosecute them. They stressed that it is the sole responsibility of the Police to carry out such actions in accordance with the law.
Cosmos Enwelizor, SAN, highlighted the importance of allowing the Police to conduct the investigation and hold accountable those responsible for the tragic incident. Similarly, retired Chief Magistrate E. O. Eferakoro criticized the Army’ s involvement and advocated for fundamental human rights applications to address the situation.
Hon. Justice Jonathan. E. Shakarho condemned the Army’ s actions as illegality and emphasized the need for the Police to handle the investigation and subsequent legal proceedings.
